End User License Agreement & Terms of Service

1. Acceptance of Terms

This End User License Agreement and Terms of Service ("Agreement") is a legal agreement between you ("you," "your," or "Customer") and Coverso CC SL ("MyCarColor," "we," "us," or "our") governing your access to and use of the MCC API, developer dashboard, documentation, and any related services (collectively, the "Service").

By creating an account, generating an API key, or otherwise accessing the Service, you agree to be bound by this Agreement. If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these terms, do not use the Service.

2. Description of the Service

The MCC API provides programmatic access to automotive paint color data, including color search, vehicle compatibility data, and related resources. The Service is offered through a tiered subscription model with varying levels of access, rate limits, and features.

3. Account Registration

To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials and API keys
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe are being used in violation of this Agreement.

4. API Keys and Access

Upon registration, you will be issued one or more API keys. API keys are personal to your account and may not be shared, sold, or transferred to third parties. You must:

  • Keep your API keys secure and treat them as confidential credentials
  • Not embed API keys in publicly accessible code repositories or client-side code
  • Immediately rotate or revoke any key that may have been compromised

We reserve the right to revoke API keys at any time if we detect abuse, a security threat, or a violation of this Agreement.

5. Permitted Use

You may use the Service to:

  • Integrate automotive color data into your applications, websites, or internal tools
  • Display color information, search results, and related data to your end users
  • Build commercial or non-commercial applications that consume the API

5.1 Restrictions

You may not:

  • Resell, redistribute, or sublicense raw API data as a standalone dataset or competing API service
  • Scrape, bulk-download, or systematically extract data beyond normal API usage patterns
  • Use the Service to build a product that directly replicates or substitutes for the MCC API
  • Circumvent rate limits, authentication mechanisms, or other technical restrictions
  • Use the Service for any illegal purpose or in violation of any applicable law or regulation
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Misrepresent your identity or affiliation when using the Service

6. Subscription Plans and Billing

6.1 Plans

The Service is offered under tiered subscription plans, each with defined rate limits, feature access, and pricing. Plan details are described on our pricing page and may be updated from time to time.

6.2 Payment

Paid subscriptions are billed in advance on a monthly or annual basis through our payment processor, Stripe. You authorize us to charge your payment method on file for all applicable fees. All fees are quoted in U.S. dollars unless otherwise stated.

6.3 Overages

If your usage exceeds the limits of your plan, additional requests may be throttled or rejected. We will not charge overage fees without prior notice and your consent. You may upgrade your plan at any time to accommodate higher usage.

6.4 Refunds

Subscription fees are non-refundable except where required by applicable law. If you cancel your subscription, you will retain access to the Service through the end of your current billing period.

7. Intellectual Property

7.1 Our Rights

The Service, including its design, code, documentation, APIs, trademarks, and all underlying data compilations, is the property of MyCarColor or its licensors and is protected by intellectual property laws. This Agreement does not grant you any ownership rights in the Service.

7.2 License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose during your active subscription period.

7.3 Your Content

You retain ownership of any content or applications you build using the Service. By using the Service, you grant us a limited right to process your API requests and associated metadata as necessary to provide the Service.

8. Data Accuracy and Disclaimer

The automotive paint color data provided through the Service is compiled from various sources and is offered for informational and reference purposes. While we strive for accuracy:

  • Color data may vary by manufacturer, region, and production year
  • RGB values, color names, and vehicle compatibility information are approximate and may not exactly match physical paint
  • We do not guarantee that the data is error-free, complete, or current at all times

You are solely responsible for validating color data against physical references before using it in any production or commercial context.

9. Service Level and Availability

We use commercially reasonable efforts to maintain high availability of the Service. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Unplanned outages, infrastructure failures, or force majeure events
  • Security incidents requiring immediate remediation

Specific uptime commitments, if any, are governed by a separate Service Level Agreement (SLA) applicable to qualifying plan tiers.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYCARCOLOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Indemnification

You agree to indemnify, defend, and hold harmless MyCarColor and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of this Agreement
  • Your violation of any applicable law or regulation
  • Any application or product you build using the Service that causes harm to a third party

13. Termination

Either party may terminate this Agreement at any time. You may cancel your subscription through the developer dashboard or by contacting us. We may suspend or terminate your access immediately if:

  • You breach any provision of this Agreement
  • Your use poses a security risk to the Service or other users
  • We are required to do so by law
  • We discontinue the Service (with reasonable advance notice)

Upon termination, your API keys will be revoked and your right to access the Service will cease. Sections 7, 8, 10, 11, 12, 14, and 15 shall survive termination.

14. Governing Law and Disputes

This Agreement shall be governed by and construed in accordance with the laws of the Kingdom of Spain. Any disputes arising out of or relating to this Agreement shall be resolved exclusively in the courts of Spain, and you consent to the personal jurisdiction of such courts.

15. General Provisions

  • Entire Agreement: This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and MyCarColor regarding the Service.
  • Modifications: We may modify this Agreement at any time by posting the revised terms on our website. Material changes will be communicated via email or a prominent notice in the dashboard. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.
  • Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign this Agreement without our prior written consent. We may assign this Agreement freely in connection with a merger, acquisition, or sale of assets.
